Washington, D. C. 9/2/2008 – Dr. Sami Al-Arian, the most prominent political prisoner in America, has been release on bail.

Welcoming the news of his release Dr. Agha Saeed, Chairman American Muslim askforce on Civil Rights and Elections (AMT) said, ” This is an important step toward restoration of due process and equal justice for all”.

*A brief history of the case is given below**:*

– Dr. Al-Arian, a nationally recognized activist for American civil rights and Palestine, was arrested on February 20, 2003 on bloated charges of terrorism; his arrest and subsequent trial was the first major test case of the PATRIOT Act.

– Alexander Cockburn has noted, this trial “featured eighty government witnesses (including twenty-one from Israel) and 400 intercepted phone calls (the result of a decade of surveillance and half a million recorded calls). One bit of evidence consisted of a conversation a co-defendant had with Al-Arian in his dream.”

– In December 2005, after 10 years of federal investigation and a six-month trial, which cost the taxpayers 50 million dollars, a Florida jury refused to return a single guilty verdict against Dr. Al-Arian.

– In a special two-page article about Dr. Al-Arian, TIME magazine reported that years of FBI investigation offered “no real links between al-Arian and terrorist acts. Nonetheless, says a former FBI supervisor involved in the case, in late 2002 word came down from Ashcroft to build an al-Arian indictment. “We were in shock, but those were our marching orders,” says the supervisor, who felt that the Justice Department was rushing to indict before it had really appraised the evidence. – On May 1, 2006, the Justice Department agreed that Dr. al Arian should be released within 30 days, and further agreed to assist in his voluntary departure from the country without other conditions, in exchange for a guilty plea to one non-violent offense.

– Nevertheless, in a clear violation of these terms, Dr. Al-Arian has been called to testify before an unrelated trial three times.

– On June 26th, 2008, Dr. Al-Arian was formally charged with criminal contempt of court for his refusal to testify. A federal judge has unexpectedly postponed the contempt trial until the Supreme Court addresses Dr. Al-Arian’s appeal.

– Civil libertarians all over the world have been calling for Dr. Al-Arian’s release.

– *Now Dr. Sami A-Arian has to await his resumption of his trial in December.*

    ALHAMDULILLAH!

    I saw a documentary about him a few months ago, and never before had I felt a weight so HEAVY on my shoulders. This is probably the best piece of news Ive heard all year Alhamdulillah!!!!!!!!!!!! Allah’s promise is invincible.
    May He bless us in this grand month of Ramadan, and allow us to gather more benefit from it than all our previous Ramadans combined. Ameeeen.

    Just FYI: those who have been working on the case have said that all of the petitions, phone calls, letters and campaigns to bring awareness to his situation have indeed helped in securing this release, and to Allah belongs all credit and praise first and last.

    Something to think about for those who are so dismissive of such attempts…wa Allahu alam.

    Good point Shaykh Sahib… the more the reason that we should push for the same things in the case of Dr. Aafia, and the more the reason to reject extremist and dichotomous lines of action to attack these issues. The American system is as much available for us to use, as it is for those who misuse it to inflict injustice on Muslims. Yes, it is harder for us because of Islamophobia, but there is always a large number of good people who are above stereotypes.

    It will be interesting to see how and if the news will cover this. TOO MANY times have so called terrorism cases ended in non-terror related guilty verdicts for charges that sound pretty bad or at least untrustworthy and the general public/casual news viewer walks away with basically the same view as if there was a full out guilty verdict on a terrorism charge…

    Let’s not allow that perception to continue. When the accused from our community is vindicated we have to REALLY make sure that it is known.

    May Allah free all who are unjustly imprisoned!

    Ameen to Shaykh Birjas’ dua. May Allah bless the families of all those unjustly held with joyous reunions in this life and the best of rewards in the next. May He soften our hearts not to judge our brothers and sisters based on the accusations of those who persecute Muslims.

    I was reading Qur’an shortly before visiting this site, and among the last ayats I read were some from Surah Aali Imran:

    142. Or do you think that you will enter Paradise while Allah has not yet made evident those of you who fight in His cause and made evident those who are steadfast?

    146. And how many a prophet (fought and) with him fought many religious scholars. But they never lost assurance due to what afflicted them in the cause of Allah, nor did they weaken or submit. And Allah loves the steadfast. 147. And their words were not but that they said, “Our Lord, forgive us our sins and the excess (committed) in our affairs and plant firmly our feet and give victory over the disbelieving people.” (Sahih International, bold and italics added)
